A transgender illegal migrant who pleaded guilty to second-degree rape of a teen boy in a New York City bodega bathroom last year will be sentenced to time served in a plea deal with prosecutors.

Nicol Alexandra Contreras-Suarez, 31, has admitted to sexually assaulting the 14-year-old in February 2025 in East Harlem.
The migrant from Colombia was reportedly promised a sentence of just six months in prison by a Manhattan Supreme Court judge on Tuesday.
The light sentence means Contreras-Suarez would be granted credit for time served and will be released from custody at sentencing on April 27, the Daily Mail reported
The Manhattan District Attorney’s Office reportedly said it offered Contreras-Suarez a plea deal after consulting with the victim’s family, sparing the teen from appearing before a grand jury and testifying at trial.
“We expect the defendant to remain detained and be deported following sentencing due to the felony conviction,” the DA’s office reportedly said in a statement.
Teen attacked in deli bathroom
Prosecutors said Contreras-Suarez followed the teen boy into a bodega in East Harlem and sexually assaulted him in the deli’s bathroom on Feb. 11, 2025, the Daily Mail reported.
The teen flagged down bystanders for help immediately after the assault, and Contreras-Suarez was taken into custody the following day.
The Colombian migrant was previously wanted in Massachusetts on robbery, weapons and prostitution charges, but was reportedly released “due to local sanctuary policies,” according to Department of Homeland Security officials.
Following the arrest of Contreras-Suarez, officials at U.S. Immigration and Customs Enforcement (ICE) obtained a detainer to take Contreras-Suarez into custody for deportation as soon as the criminal trial is over.
“This creep should’ve never been released into our country,” then-DHS assistant secretary Tricia McLaughlin reportedly said in a statement at the time of the arrest of Contreras-Suarez.
McLaughlin blamed “failed sanctuary policies and Biden’s open-border agenda” for the allowing “this serial criminal was freed to prey on innocent American children.
